The protection of public health of Irish rural dwellers from the hazards of wind turbine noise falls under the long outdated Wind Energy Development Guidelines 2006; guidelines which in turn are based on ETSU-R-97 "The Assessment and Rating of Noise from Wind Farms" issued by the UK Department of Trade and Industry in September, 1996.

Ten years have passed since the Irish guidelines were issued, ten years during which the size of wind turbines has increased exponentially, and during which the international knowledge of the public health hazards of low frequency noise and infrasound have been well researched, peer-reviewed and published.  Unknown no longer washes.

In December 2013, the Department of Housing, Environment and Local Government published for public consultation a proposed "Targeted Revision" of the guidelines which would guarantee a setback distance of 500m from people's home.  They received 7300 submissions, most of which pointed out that this was totally inadequate and far less than international best practice.

The government of the day kicked the can down the road and did nothing for over two years.  Public disquiet has forced the new administration to commit to publishing revised wind development guidelines within 6 months.  The Minister confirmed in May that "The revisions to the guidelines will be informed by the public consultation process and best international practice".  

However, the "best international practice" that informed the draft proposals back in November 2013 have long since been overtaken by larger and more powerful technology; in today's terms, 500 metres is woefully inadequate, and is guaranteed to lead to public health issues in the future.  In Germany, the Constitutional Court of Bavaria has upheld the State setback rule of 10 times tip height that has been in force since 2014, and the Polish National Institute of Public Health has recommended a minimum setback of 2km.

The Irish renewable energy action plan has already been found to have lacked proper public consultation by the UNECE, a finding that has been accepted by the European Commission and Ireland.  It is the Minister's intention that "My Department will continue to advance work on the Guidelines in conjunction with the Department of Communications, Energy and Natural Resources".

The only way that the Minister can advance work on the guidelines at this remove is to immediately issue fresh draft guidelines that reflect international best practice as enforced by fellow European countries, repeat the public consultation and then enact the enabling legislation so that the public can have confidence that the issue has been dealt with in a fair and transparent manner.

The new Irish Government, with its large contingent of Independent members now has the opportunity to transparently show that it really does have the health interests of its rural citizens at heart.  Or it can revert to the "same old, same old" gombeen mentality politics of the past behind closed doors.  The jury is out; watch the spot.

La protection de la santé publique des populations rurales Irlandaises contre les dangers du bruit des éoliennes est règlementé par des directives obsolètes datant de 2006.

Ces directives sont basées sur la norme  ETSU-R-97 « L’évaluation et notation des bruits des parcs éoliens » publiées en Septembre 1996 par le ministère britannique de Commerce et de l’Industrie.

Dix ans se sont écoulés depuis que les directives Irlandaises ont été émises, dix ans au cours desquelles la taille des éoliennes a augmenté de façon exponentielle, et au cours desquelles les connaissances internationales des dangers concernant la santé publique de santé publique  du bruit de basses fréquences et des infrasons émises par ces machines , ont été bien étudiées, vérifiées et publiées.

En Décembre 2013, dans le but d'une consultation publique, le ministère de l’Environnement a publié un projet de « révision ciblée » des directives qui garantissent une distance des éoliennes de 500 m des habitations. Il a reçu 7300 réponses qui pour la plupart ont constaté  que c’était tout à fait insuffisant et bien inférieur au meilleures pratiques internationales.

Le précédent gouvernement  n’a rien fait pendant plus de deux ans. L’inquiétude publique a forcé la nouvelle administration à s'engager à publier dans les six mois, une directive révisée concernant le développement éolien. En Mai le Ministre a confirmé que « les révisions des directives seront soumises à un processus de consultation publique et suivront les meilleures pratiques internationales ».

Cependant, « les meilleures pratiques internationales » qui en Novembre 2013 ont servi de base aux propositions préliminaires, ont depuis longtemps été dépassées, les éoliennes étant de plus en plus grandes et de plus en plus puissantes. Aujourd’hui une distance de protection de 500 mètres est totalement  insuffisante, et elle est assurée de conduire à des problèmes de santé publique dans le futur. En Allemagne la Cour Constitutionnelle de Bavière a confirmé la règlementation de la région (10H) soit  de dix fois la hauteur de l'éolienne en bout de pale et qui est légalement en vigueur depuis 2014.
L’Institut National Polonais de la Santé Publique a recommandé de son côté un retrait minimal de 2 km.

Le plan d’action de l’énergie renouvelable Irlandaise a déjà été reconnu coupable par l'UNCE de n'avoir pas effectué une consultation publique appropriée,  constatation qui a été actée par la Commission Européenne et l’Irlande. Les intentions actuelle du Ministre sont résumées par: « mon ministère continuera à faire avancer les travaux sur les directives en collaboration avec le ministère de Communications, de l’Energie et des Ressources Naturelles ».

La seule façon pour le Ministre de faire avancer les travaux concernant ces règlements est de publier immédiatement un projet de nouvelles  directives qui reflèteront les meilleures pratiques internationales appliquées par les autres pays Européens et  refaire  une consultation publique pour adopter une  loi dont les citoyens puissent avoir l’assurance que cette a question a été traitée de manière équitable et transparente.

Der Schutz der öffentlichen Gesundheit der irischen Landbevölkerung vor den Gefahren des Wind Turbinen Lärms fallen unter den vor langen veralteten Windenergieentwicklung Richtlinien 2006: diese wiederum basieren auf ETSU-R-97 " Die Beurteilung und Bewertung von Lärm von Windparks " ausgegeben vom britischen Ministerium für Handel und Industrie im September 1996.

Zehn Jahre sind vergangen, seit die irischen Richtlinien erlassen wurden, zehn Jahre, in denen die Grösse von Windenergieanlagen exponentiell zugenommen hat, und bei dem das internationale Wissen über die Gefahren der öffentlichen Gesundheit von Niederfrequenzrauschen und Infrageräusch gut erforscht, überprüft und veröffentlicht wurden. Unwissenheit zählt nicht mehr.

Im Dezember 2013 veröffentlichte das  Ministerium fuer Wohnen, Umwelt und örtliche Regierung eine vorgeschlagene “gezielte Revision” der Richtlinien, die einen Abstand von 500 Metern von Bewohnern und deren Häusern und Windmuehlen garantieren würde, für öffentliche Diskussion. Sie erhielten 7300 Einreichungen, von denen die meisten darauf hinwiesen, dass dies völlig unzureichend wäre und viel weniger als internatial bewährtes Verfahren.

Die Regierung des Tages drehte die Daumen und tat nichts mehr für zwei Jahre. Öffentliche Beunruhigung hat die neue Verwaltung dazu gezwungen sich zu verpflichten eine neue, überarbeitete Wind Entwicklungs Richtlinie innerhalb von 6 Monaten zu veröfflichen. Der Minister bestätigte im Mai, dass:”Die Änderungen an den Richtlinien werden von dem öffentlichen Diskussion Prozess und bester internationaler Praxis informiert/beeinflusst werden”.

Jedoch: Die “beste internationale Praxis”, die von den Entwurfsvorschlägen zurück vom November 2013 informiert wurde sind längst von grösserer und leistungsfähiger Technik überholt worden; in heutigen Begriffen sind 500 Meter völlig unzureichend und es ist garantiert dass es zu  zukünftigen, öffentlichen Gesundheitsproblemen führen wird. In Deutschland hat das bayrische Verfassungsgericht die Staatsregel von einen  Rückschlag/Abstand von 10 mal Spitzenhöhe bestätigt, die seit 2014 in Kraft ist. Das polische Insitut für öffentliche Gesundheit hat einen Minimum Rückschlag/Abstand von 2km empfohlen.

UNECE hat befunden, dass  es  an einer richtigen, öffentlichen Konsultation des irischen, erneubaren Energieplans mangelte, ein Befund, der von der Europäischen Kommision und von Irland akzeptiert worden ist. Es ist die Absicht des Minister, dass “Meine Abteilung wird weiterhin die  Entwicklung von den Richtlinien, in Verbindung mit dem Ministerium für Kommunikation, Energie und natürlichen Ressourcen foerdern.”

Die einzige Weise wie der Minister mit den Richtlinien vorrücken kann ist das er sofort  neue Entwürfe von Richtlinen ausgibt, welche die beste internationale Praxis wiederspiegeln, die von anderen europäischen Ländern durchgesetzt sind, das Wiederholen der öffentlichen Konsultation und and dann das Ermächtigungsgesetz erlassen, damit die Öffentlichkeit  das Vertrauen haben kann, dass das Problem auf eine faire und durchschaubare Weise behandelt wurde.

Die neue irische Regierung mit seiner grossen Kontigent unabhängiger Mitglieder hat nun die Möglichkeit transparent zu zeigen dass es wirklich die gesundheitlichen Interessen der ländlichen Bürger am Herzen hat. Oder es kann,  hinter verschlossenen Türen zu der “gleichen alten, selben alten” …..Mentaliltäts Politik der Vergangenheit zurück kehren.

Bewoners van het ierse platteland worden beschermd tegen de geluidsrisico's van windmolens door de richtlijnen in de Wind Energy Development Guidelines van 2006. Richtlijnen die op hun beurt gebaseerd zijn op ETSU-R 97,' the Assessment and Rating of Noise from Windfarms', uitgegeven door het engelse ministerie voor Trade and Industry, in september 1996.

Deze richtlijnen zijn uit de tijd.

Sinds ze werden afgegeven zijn 10 jaar verstreken. En in die afgelopen 10 jaar is de afmeting van windmolens exponentieel toegenomen, en is er internationaal degelijk onderzoek verricht naar de gezondheidsrisico's van geluid met lage frequentie en infrasound. Dit onderzoek is beoordeeld en bekritiseerd onder collega-wetenschappers, en het is gepubliceerd. Gebrek aan kennis kan geen excuus meer zijn.

Het ierse departement voor 'Housing, Environment and Local Government' heeft de beoogde herziening van de richtlijnen  gepubliceerd voor openbare consultatie in december 2013. Er werd een gegarandeerde afstand van 500 meter tot het dichtstbijzijnde huis voorgesteld. Erv kwamen 7300 reacties binnen, en de meeste daarvan wezen erop dat die afstand absoluut onvoldoende was, en veel minder dan wat internationaal geldt als de beste standaard.

De regering die er toen zat schoof de zaak op de lange baan, en deed meer dan twee jaar niets.  Onrust onder het publieke heeft de huidige regering gedwongen zich vast te leggen op de publicatie, binnen zes maanden, van herziene richtlijnen voor windenergie-projecten. De verantwoordelijke minister heeft in mei bevestigd dat de nieuwe richtlijnen rekening zullen houden met de uitkomsten van publieke raadpleging en de beste internationale praktijken.

Echter, de beste internationale standaard waarvan ontwerpvoostellen van nov. 2013 zouden uitgaan ois allang achterhaald door grotere en krachtigere technologie. En daardoor zijn op de dag van vandaag die 500 meters pijnlijk onvoldoende. Nu zijn ze een garantie voor in de toekomst problemen met de gezondheid van de bevolking.

In Duitsland heeft het Constitutionele Hof voor Beieren de door de deelstaat uitgevaardigde regel van een afstand van 10x de hoogte tot de top, die gold sinds 2014, overeind gehouden.  En het Poolse nationale Instituut voor de Volksgezondheid heeft een afstand van minstens 2 km. aanbevolen.

De enige manier waarop de minister nu verder kan met richtlijnen, is door de  onmiddellijke publicatie van een nieuw ontwerp, dat de beste internationale standaard volgt die geldt in andere europese landen. Hij moet opnieuw de bevolking raadplegen, en dan door wetgeving de toepassing van de nieuwe normen mogelijk maken. Zodat het publiek erop kan vertrouwen dat deze zaak op een eerlijke en transparante wijze behandeld is.

De nieuwe ierse regering, waarvan  een grote groep onafhankelijken deel uitmaakt, heeft nu de kans om op transparante manier te laten zien dat ze opkomt voor de gezondheid van de bevolking op het platteland. Zoniet dan zal het weer het oude liedje worden van de achterkamertjespolitiek uit het verleden. We weten nog niet hoe het af zal lopen. Maar hou het in de gaten.
